false-claims-fileRecently in Florida, one of the largest settlements under the False Claims act has been reached. Steven J. Wasserman, a dermatologist has agreed to pay over $26 million to resolve allegations against him. He was accused of entering an illegal kickback arrangement and performing unnecessary procedures on patients and billing Medicare for them.

What is The False Claims Act?

The False Claims Act is a law that places liability on anyone or any business that defrauds any governmental program. This act includes a provision called the qui tam (commonly called the whistleblower). This provision enables a party to file a suit on behalf of the government if they are aware of some form of fraudulent behavior. The party that files this suit then becomes entitled to some of the settlement that is reached. In the case mentioned above, the claim was filed by Alan Freedman M.D, a pathologist who formerly worked at the firm that Dr. Wasserman had entered into a kickback agreement with. Dr. Freedman will receive over $4 million from the settlement.

“Doctors who take illegal kickbacks and perform unnecessary procedures not only put their own financial self-interest over their duty to their patients, they raise the cost of health care for all of us as patients and as taxpayers,” said Stuart F. Delery, Principal Deputy Assistant Attorney General for the Civil Division of the Department of Justice. “The Department of Justice will not tolerate those who abuse the public health care programs to which we all contribute and on which we all depend.” Dr. Wasserman was charged with performing tests and procedures on patients that were not medically necessary.
