Product Liability

Product liability requires the manufacturers and sellers of defective products to compensate buyers for injuries or damages suffered as a result of the defect in the product sold. Manufacturers of consumer products are responsible for making products that are safe for consumer use. Laws require that manufacturers safely design and manufacture products as well as include proper warning labels.

In instances where products are not safely designed, manufactured or properly warned against, manufacturers and sellers of defective products can be held liable for injuries sustained.

Product liability laws vary from state to state. In Massachusetts, it is illegal to manufacture or sell an unreasonably dangerous product. When a person is injured or worse killed by a defective product, Massachusetts law imposes liability on the manufacturer and seller of that defective product. The manufacturer and seller of a defective product may be required to pay damages, including double or triple damages as well as attorney’s fees.
